they are hassassing me at my job and home. governs how a collection agency can try to collect a debt. One thing that they can%26#039;t do is harass a debtor. At the very least, I would send the collection agency a letter that states, %26quot;I dispute the validity of this debt. Please provide me with verification%26quot; - which you have the right to do under the FDCPA.

  • They don%26#039;t really investigate but they do have people specializing in skip tracing -- that%26#039;s where they track down debtors.

You can tell them to stop calling you at work as your employer does not permit personal calls. But they can call you at home every day. If you don%26#039;t actually speak to them when they call you at home, they can keep calling back leaving messages.

You can send them a certified, return receipt letter requesting they cease and desist all contact. They have to stop. But don%26#039;t be surprised it they don%26#039;t immediately sue you.

You might try negotiating a settlement. If the debt is over 3 years old, offer 25%; 2 or 3 years old, offer 50%; less than 2 years old, offer 75%. Lump sum gets the best deal. Payment plans have to be short term.

Get ANY settlement agreement in writing and keep it, along with your payment proof, forever. Do not give the collector direct access to your bank account.
  • Yes

. And by the way, it is YOUR debt, that you owe to THEM., not the other way around.
